The Supreme Court of the United States (SCOTUS) ruled against Trump’s earlier tariff approach. That approach set tariffs on different countries at between 10 and 50 percent. The court decided that the policy, which relied on the International Emergency Economic Powers Act (IEEPA), exceeded the president’s authority.
On Friday, February 20, President Trump announced that the US would immediately impose a full 10 percent tariff after the court released the verdict. But later, he hiked the rate to 15 percent via another set of laws called Section 122. The law lets the president set tariffs of up to 15 percent. However, Congress has to approve them if they stay in place for more than 150 days.
On Truth Social, President Donald Trump declared that he would utilize the 150-day period to prepare for additional tariffs that the law “allows.”
“As President of the United States, I will raise the global tariff from 10 to 15 percent right away. Courts have reviewed and upheld this as fully legal,” Trump stated. He said that several countries had taken advantage of the US for decades without giving anything back in trade.
The move shows that Trump is still committed to his global trade plan. This remains true even after the Supreme Court ruled 6-3 that his prior approach was too broad. Trump blasted some of the judges in the hours after the verdict. He also said again that he believes he still has the power to change trade policy within the law.
Analysts say the decision might make trade tensions across the world worse. This could happen, especially if Congress talks about whether to keep the levy in place for more than the first 150 days.
